Project Deliverables
For custom development work, ownership of the final product will be specified in your service agreement. Typically, once you've paid in full, you own the custom code we've written specifically for you.
Note: Third-party libraries, frameworks, or services incorporated into your project may have their own licensing terms.
Payment Terms
We believe in transparent pricing and fair compensation for our work:
- Project Fees – For custom development work, we'll provide a detailed quote before starting. This may be a fixed price or hourly rate, depending on the project scope.
- Payment Schedule – Typically, we require a deposit before starting work, with remaining payments tied to project milestones or deliverables.
- Late Payments – Payments not received by the due date may incur a late fee and could result in work being paused until payment is received.
- Taxes – All fees are exclusive of applicable taxes, which will be added to your invoice if required by law.

Limitation of Liability
Here's the legal bit we can't avoid (but we've tried to make it readable):
To the maximum extent permitted by law, NexGenix Technologies will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.
In no event shall our total liability for any claims relating to our services exceed the amount paid by you for the services in question during the twelve (12) months prior to the event giving rise to the liability.
In human terms: We'll do our absolute best work for you, but we can't be responsible for every possible thing that might go wrong, especially factors outside our control. Our liability is limited to what you've paid us.
Termination
Either party can end the relationship under these conditions:
You Can Terminate If:
- You're not satisfied with our services
- You no longer need our services
- We breach these Terms and don't fix the issue
We Can Terminate If:
- You breach these Terms
- You fail to pay for services
- We can no longer provide the services
- We cease operations
If either party terminates, you'll need to pay for any services already rendered. The specific termination process and any applicable fees will be outlined in your service agreement.
Governing Law
These Terms are governed by the laws of South Africa. Any disputes will be resolved in the courts of Johannesburg, South Africa.
We always prefer to resolve any issues amicably through direct communication before resorting to legal proceedings. If you have concerns, please reach out to us first.
Changes to These Terms
We may update these Terms from time to time to reflect changes in our practices, services, or legal requirements. When we make significant changes, we'll:
- Post a notice on our website
- Update the "last updated" date at the top of these Terms
- Notify existing clients via email for substantial changes
Your continued use of our services after changes to the Terms constitutes acceptance of the updated Terms.
The Legal Bits

- Severability – If any part of these Terms is found to be unenforceable, the rest still applies.
- No Waiver – If we don't enforce a provision of these Terms, that doesn't mean we're waiving our right to do so later.

- Entire Agreement – These Terms, along with any service agreements, constitute the entire agreement between us regarding our services.
